1. Acceptance of Terms
By accessing or using the True Berry website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Services
True Berry provides berry packaging design, manufacturing, and distribution services for business customers (B2B). Our services include custom packaging design, production, quality assurance, warehousing, and delivery.
3. Orders and Pricing
All orders are subject to acceptance by True Berry. Prices are quoted based on specifications, materials, quantities, and delivery requirements. Quotes are valid for 30 days unless otherwise stated.
- Orders are confirmed upon receipt of a signed purchase order
- Pricing may vary based on material costs and market conditions
- Custom design fees are non-refundable once production begins
- Volume discounts are applied automatically based on order size
4. Payment Terms
Payment terms are Net 30 for established accounts. New customers may be required to pay a 50% deposit upon order confirmation with the balance due upon delivery. Late payments are subject to a 1.5% monthly service charge.
5. Delivery and Shipping
Delivery dates are estimates and True Berry shall not be liable for delays caused by circumstances beyond our control. Title and risk of loss pass to the buyer upon delivery to the carrier. Claims for damaged or missing goods must be filed within 48 hours of delivery.
6. Quality Guarantee
All products are manufactured to meet or exceed food safety standards including FDA 21 CFR requirements. We guarantee our products against manufacturing defects. Claims must be submitted with photographic evidence within 30 days of delivery.
7. Intellectual Property
All True Berry branding, designs, and proprietary packaging technologies remain the intellectual property of True Berry. Custom designs created for clients become the client's property upon full payment. True Berry retains the right to use anonymized project data in our portfolio.
8. Limitation of Liability
True Berry's liability for any claim arising from our products or services shall not exceed the total amount paid by the customer for the specific order in question. We are not liable for indirect, incidental, or consequential damages.
9. Cancellation
Orders may be cancelled without charge if production has not begun. Once production starts, cancellation fees may apply based on materials used and production time invested. Custom printed orders cannot be cancelled once printing has started.
10. Governing Law
These terms are governed by the laws of the State of Oregon, USA. Any disputes shall be resolved in the courts of Multnomah County, Oregon.
